We value the privacy of our visitors. It is our policy to respect your privacy regarding any information we may collect from you across our Website https://bardel.ca/, including both online and mobile versions (collectively our “Websites”).
This Privacy Policy governs our Websites made available by Bardel Entertainment Inc. and/or Divertissement Bardel (QC) Inc./ Bardel Entertainment (QC) Inc. (collectively, “Company”, “we” “our” or “us”), including your use of interactive features, widgets, plug-ins, applications, content, downloads and/or other services that we own and control, regardless of how you access or use our Websites, whether via computer, mobile device or otherwise (collectively our “Services”). Subject to applicable law, this Privacy Policy does not apply to our data collection activities offline or otherwise outside of our Websites and does not govern the data practices of third parties that you may interact with on our Websites.
CONSENT AND EXCEPTIONS
By using our Websites, you hereby consent to our Privacy Policy and agree to its terms.
If you are a Quebec resident, please note that under the Act respecting the protection of personal information in the private sector, your specific consent to process your data when you visit our Websites is not necessary. We base this on an exception under the Act respecting the protection of personal information in the private sector, specifically for the purpose of providing a service requested by the person concerned (in this instance your request to navigate our Websites).
Note that if you are a resident of any European nation, we process your information pursuant to either a legitimate business interest or per European adequacy decisions regarding Canadian data protection regulations. As such the law does not currently require us to procure your specific consent to process your information in our servers in Canada or elsewhere.
INFORMATION WE COLLECT
Bardel does not initially collect personally identifiable information. However, if you contact us directly, we may receive additional information about you such as your name, email address, phone number, the contents of the message and/or attachments you may send us, and any other information you may choose to provide (collectively your “Personal Information”).
Some information is also collected automatically when you visit our Websites. This information may not on its own reveal your name or contact information, but it may include device and usage information, such as your IP address, browser, device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services and other technical information. This information is primarily needed to maintain the security and operation of our Websites, and for our internal analytics and reporting purposes, but we also use this information to improve our Websites, to determine which features of our Websites are most popular with our visitors, and to otherwise better understand our visitors’ preferences.
The technologies we use for this automatic data collection may include:
- Cookies (or browser cookies). “Cookies” are small text files that are placed on your device by a Web server when you access our Websites. Please see our Cookie Notice for more details.
- Web Beacons. Pages of the websites and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
- Do Not Track. Please note that our Websites do not currently respond to browser-based “do not track” signals. We will respond to any similar signals in the future as may be required by applicable law.

HOW WE USE YOUR INFORMATION
We only retain collected information for as long as necessary to provide you with your requested service. What data we store, we’ll protect within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use or modification.
We do NOT sell your Personal Information, and as such you do not have to Opt-in or Opt-out of any sale of information requirements under the law. Furthermore, other than cookie information collected as detailed in our Cookie Notice, we do not share your information with our Service Providers or with Third Parties.
THIRD PARTY PRIVACY POLICIES
Bardel’s Privacy Policy does not apply to third-party operators or other websites. Thus, we are advising you to consult the respective privacy policies of these third parties for more detailed information. It may include their practices and instructions about how to opt-out of certain options. For instance, WordPress states the following in its home page:
“Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.”
Our Websites use The WordPress Multilingual Plugin services as a third-party service, and when you access our Websites, you are agreeing to be subject to, and treated in accordance with, the WordPress Multilingual Plugin Privacy Policy: https://wpml.org/documentation/privacy-policy-and-gdpr-compliance/. Note that our WordPress subscription includes various plug-ins, as noted in our Cookie Notice. Note further that WordPress also collects user submitted data such as name and email address through its Contact Form CFDB7 plug-in.
You can choose to disable cookies through your individual browser options. To know more detailed information about cookie management with specific web browsers, it can be found at the browsers’ respective websites.
EXERCISING YOUR PRIVACY RIGHTS
Depending on where you live, and subject to our obligations under applicable laws, you may have certain rights and choices regarding your Personal Information. For example, in addition to choices described elsewhere in this Privacy Policy, you may have some or all of the following rights and choices in general:
GENERAL REGIONAL RIGHTS
- Access Rights: You may have the right to receive certain information, such as the following (these rights, and the applicable types of data and time periods, will vary depending on the laws applicable to the state or country in which you reside):
- The categories of Personal Information we have collected or disclosed about you; the categories of sources of such information; the business or commercial purpose for collecting your Personal Information; and the categories of third parties with whom we shared Personal Information.
- Access to and/or a copy of certain Personal Information we hold about you.
- In some circumstances, you may have the right to obtain certain Personal Information in a portable format.
- Erasure: You may have the right to request that we delete certain Personal Information we have about you. We may either decide to delete your Personal Information entirely, or we may anonymize or aggregate your Personal Information such that it no longer reasonably identifies you, and may use it to improve our Services. Certain Personal Information may be exempt from such requests under applicable law. For example, we need certain types of information so that we can provide our Services to you, we may be required to retain certain information for legal purposes, and there may be other reasons we may need to keep certain Personal Information under various applicable laws. In addition, if you ask us to delete your Personal Information, you may no longer be able to access or use some of our Services.
- Correction: You may have the right to request that we correct certain Personal Information we hold about you.
- Limitation of Processing: Certain laws may allow you to object to or limit the manner in which we process some of your Personal Information, including the ways in which we use or share it. For example, you may have these rights if the processing was undertaken without your consent in connection with our legitimate business interests (although we may not be required to cease or limit processing in cases where our interests are balanced against your privacy interests).
- Regulator Contact: You may have the right to contact or file a complaint with regulators or supervisory authorities about our processing of Personal Information. To do so, please contact your local data protection or consumer protection authority.
- Postings by Minors: Users of our Services under the age of 18 in certain jurisdictions have the right to require that we delete any content they have posted on one of our Services.
- Other: You may have the right to receive information about the financial incentives that we offer to you, if any. You may also have the right to not be discriminated against (as provided for in applicable law) for exercising certain of your rights.
If you believe that you have specific rights under your jurisdiction and you would like to exercise any of these rights, please submit a support request through our Websites or by email at privacy@bardel.ca.
Other than marketing opt-out you will be required to verify your identity before we fulfill your request. In certain jurisdictions, you may be able to designate an authorized agent to make a request on your behalf, subject to certain requirements of your applicable law. We may require that you provide the email address we have on file for you (and verify that you can access that email account) as well as an address, phone number, or other data we have on file, in order to verify your identity. If an agent is submitting the request on your behalf, we reserve the right to validate the agent’s authority to act on your behalf, and we may be required to take additional verification measures under applicable law.
IMPORTANT INFORMATION FOR EUROPEAN UNION AND UNITED KINGDOM USERS
If you are a user from the European Union or United Kingdom you should be aware that we are the controller of your Personal Information (Data Controller) under the EU General Data Protection Regulation (“GDPR”), the UK General Data Protection Regulation (“UK GDPR”), and such similar laws promulgated in the various EU countries.
You may have certain additional rights regarding your Personal Information (as defined in the GDPR and UK GDPR, for instance), including the right to:
- access your information;
- rectify your information if it is incorrect or incomplete;
- have your personally identifiable information erased (“right to be forgotten”) if certain grounds are met;
- withdraw your consent to our processing of your information at any time, if our processing is based on consent;
- object to our processing of your information, if our processing is based on legitimate interests;
- object to our processing of your information for direct marketing purpose; and
- receive your information from us in a structured, commonly used, and machine-readable format, and
- the right to transmit your information to another controller without hindrance from us (data portability).
There is no charge for any of these requests. To make a request, please contact us at privacy@bardel.ca. We try to respond to such requests in a timely manner, but in no event longer than one month.
When we collect your Personal Information, we maintain and store it for as long as we determine reasonably necessary to provide our Services to you, unless you exercise your right to erasure described above, or to comply with applicable legal requirements.
If you are a citizen of the European Union or United Kingdom, when we process your Personal Information, we will only do so in the following situations:
- We have a contractual obligation.
- You have provided your consent. You are able to remove your consent at any time, and you may do this by contacting us at privacy@bardel.ca.
- We have a legal obligation.
- We have a legitimate interest in processing your Personal Information. For example, we may process your Personal Information to send you marketing communications, relevant content, products or events invitations, or to communicate with you about changes to our Services, and to provide, secure, and improve our Services.
You should be aware that Personal Information that you provide to us may be transferred out of the country in which you reside to servers in a country that may not guarantee the same level of protection as the one in which you reside. We do this for a legitimate business purpose, and therefore specific consent is not required under the EU and UK legal schema.
We will take all steps reasonably necessary to ensure that your Personal Information is treated securely in accordance with this Privacy Policy, and no transfer of your Personal Information will take place to a third party unless there are adequate controls in place to protect your Personal Information and/or you have provided contractual consent by becoming a client.
If you are a user in the European Union or United Kingdom and have a concern about our processing of personal information that we are not able to resolve, you have the right to lodge a complaint with the data privacy authority where you reside. INFORMATION FOR U.S. RESIDENTS
Various U.S. states (e.g., as of the date of this Privacy Policy, California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah and Virginia) allow consumers to opt out of sharing of their data and also provide certain other privacy rights. As such, residents of those states may request that the Company:
- Disclose the sources, categories, and specific pieces of personal information we have collected about them, how that information is used, and with whom the Company shares it.
- Disclose the purpose for collecting personal information.
- Disclose the categories of third parties with whom the Company shares personal information.
- Delete/rectify/restrict their personally identifiable information, subject to certain exceptions (right of rectification not applicable to Utah residents).
- Though not specifically applicable to this Company, to disclose, for any “sales” of personal information, the categories of personal information collected and sold and to what categories of third parties it was sold.
- Though not specifically applicable to this Company, to opt them out of sales of their personal information (if any) or subject certain personal information to automated decision-making algorithms (not applicable to Utah residents).
- Provide a copy of their personal information in a readily usable format that allows the information to be transmitted to others.
- Residents in these states may not be discriminated against for exercising any of the rights described above.

In the preceding twelve (12) months, we have not disclosed Personal Information with any third parties, except for cookie information collected, as noted in our Cookie Notice.
CANADA PERSONAL INFORMATION PROTECTION AND ELECTRONIC DOCUMENTS ACT (PIPEDA)
This privacy policy reflects our adherence to the Personal Information Protection and Electronic Documents Act (PIPEDA), which governs the collection, use, and disclosure of personal information in Canada. Under PIPEDA, individuals have the right to access their personal information, request corrections, and inquire about our privacy practices. We are committed to safeguarding personal information and ensuring its accuracy, confidentiality, and security. Our collection, use, and disclosure of personal information are limited to purposes that are reasonable and appropriate.
BRITISH COLUMBIA PERSONAL INFORMATION PROTECTION ACT (PIPA)
This privacy policy outlines our commitment to protecting the personal information of consumers in accordance with applicable privacy laws, including the Personal Information Protection Act (PIPA) in British Columbia. Under PIPA, consumers have the right to access their personal information held by us, request corrections to inaccurate information, and inquire about our privacy practices. We are dedicated to ensuring the security and confidentiality of personal information and will only collect, use, and disclose it for purposes that are reasonable and appropriate.
QUÉBEC ACT RESPECTING THE PROTECTION OF PERSONAL INFORMATION IN THE PRIVATE SECTOR (P-39.1)
This privacy policy reflects our compliance with Quebec’s privacy law, the Act Respecting the Protection of Personal Information in the Private Sector. This law governs the collection, use, and disclosure of personal information by private sector organizations in Quebec. Under this law, individuals have the right to access their personal information, request corrections, and inquire about our privacy practices. We are committed to protecting personal information and will only collect, use, and disclose it for purposes that are reasonable and appropriate.
If you are a Quebec resident, please be advised that we may transfer the Personal Information we collect from and about you outside of the Province of Quebec, including to other Canadian provinces, territories and foreign countries. Note that other countries or provinces may not have the same standards for protection of Personal Information as that of Quebec. However, if we transfer your Personal Information outside of Quebec, we will require any receiving entity to adhere to appropriate privacy and security standards.

It is our policy to post any changes we make to this Privacy Policy on this page with a notice that the Privacy Policy has been updated on the website home page. If we make material changes to how we treat our users’ personal information, we will notify you through a notice on our Website’s home page. The date this Privacy Policy was last revised is identified at the top of the page. You are responsible for periodically visiting our Website and this Privacy Policy to check for any changes.
